1. Welcome

Welcome to the General Terms of Service for Nova capital. These terms, in combination with our pricing page, issuer terms (if applicable), and other documents referenced in these terms (collectively, "Terms"), form a legal agreement between: It has been decided.

Risk Warning Regarding Digital Payment Token Service

M.I.S.A. - Mwali International Services Authority, as a customer of Digital Payment Token (DPT) service providers, is requesting that this risk warning be provided. Before paying money or DPT to your DPT service provider, you need to be aware of the following:

DPT service providers are exempt from holding a license to provide DPT services by MAS. Please note that if your DPT service provider's business fails, you may not be able to recover all the money or DPT you paid to your DPT service provider.

If you are not familiar with this DPT, please do not trade with DPT. If you are not familiar with the technology provided by the DPT service, trading with DPT may not be appropriate.

Please note that the value of DPT can fluctuate significantly. Buy DPT only if you are ready to accept the risk of losing all the money you put into such tokens.

Please read this document carefully to understand how your account and our services work. If you do not agree to these terms, please do not sign up or use our services. Different terms may apply to users in certain regions.

2. Our service

Nova capital operates an application that can be downloaded to mobile devices (“apps”).

The information provided through the  Nova capital Services is not intended or constitutes any financial or other advice. It is common in nature and not unique to you. It is not an offer or solicitation to buy or sell a security, product, service, or investment, nor is it a recommendation, approval, or sponsorship of a security, company, or fund.

You should carefully evaluate whether your financial position and risk tolerance are suitable for transactions made using Nova capital services. You are also responsible for conducting your own research before making a transaction through the Nova capital service.

3. Who are we.

The conditions that apply to you may vary depending on where different Nova capital companies serve you and where you normally reside, and where you create your Nova capital profile and / or Nova capital account.

4. Nova capital profile

To use the Nova capital service, you must register using email, set up an account with a password, and verify your identity (“Nova capital Profile”).

We recommend that you use strong passwords that combine letters, numbers, and special characters in your Nova capital profile. Two-factor authentication must be enabled to access the Nova capital profile.

For more information about the steps you need to take to protect your Nova capital profile, see the security section below (paragraph 9).

5. Security

It's very important to keep your Nova capital profile secure at all times. You are responsible for all transactions initiated through your  Nova capital profile. Unauthorized use of Nova capital profiles can have serious consequences, including financial implications. Ultimately, it's your responsibility to keep your Nova capital profile secure in the following ways:

Use a strong password for your Nova capital profile.

Keep your phone safe and make sure it is always password protected.

Enable two-factor authentication to access your Nova capital profile.

Securely store your Nova capital card PIN and other unique numbers.

Close the app when not in use.

Log out of the Nova capital site when you're not using it.

Change your mobile phone, card PIN, and Nova capital account password regularly and don't share it with anyone. And

Keep your email account secure at all times.

If you believe your mobile phone, Nova capital card, or Nova capital profile login information has been lost, stolen, or accessed without permission, you should immediately contact support@novacapital.info or the app's Help Center. 7. Eligibility

To create a Nova capital profile, you must meet the following criteria:

You must be at least 18 years old and live in a country where Nova capital is available.

You need to open one account with us and you must not have a previous account that was blocked or closed.

You need to verify your identity with us and pass other checks that we need to perform (such as money laundering prevention checks and knowing customer procedures).

8. AML / KYC verification

We adopt Money Laundering Prevention (AML), take our customer (KYC) policy very seriously, and monitor the platform for suspicious activity. All requests must be met to verify your identity, address and source of funding.

You may be required to provide a valid government-issued ID and may require you to provide an address certificate issued in the last 6 months.

If we cannot verify your identity or the validity of the document, your Nova capital profile will be rejected. If you are on the government or intergovernmental sanctions list, your Nova capital profile will be rejected.

9. Restrictions on using Nova capital.

Do not use the Nova capital service for any of the following:

Illegal purposes, including fraud and money laundering, and purposes prohibited by regulation, decree, ordinance, or other government or regulatory restrictions.

For the purpose of debt collection.

To circumvent merchant restrictions or get goods and services without paying.

For the purpose of commercial speculative trading.

To manipulate the price of an asset or currency.

Any method that may result in complaints, cancellations, chargebacks, fees, fines, penalties, or other liability to Nova capital, other users, third parties, or yourself.

To provide cash advances from credit cards, or to help others do so.

Any way to bring a negative balance in any currency.

It promotes viruses, malware, malicious code, or other forms of IT attacks or attempts to access systems and information to overwhelm or overload the infrastructure.

To interfere with the Nova capital service in any way.

Copying or copying our content or services in any way.

To interfere with a third party provider in any way.

To test the operation of your credit card.

To avoid our policies and procedures.

For use in automated transactions, APIs, crawler scripts, or other methods that conflict with normal use of Nova capital services.

For crowdfunding purposes or to receive revenue from crowdfunding campaigns.

To harass employees, agents, or other users.

10. Nova capital relief

If you violate these Terms in any way, we may, in our sole discretion, take the following actions:

Close, suspend, or restrict access to your Nova capital profile or Nova capital account.

Contact and / or warn third parties in connection with your actions, including other users, banks or card issuers, law enforcement agencies, regulators, etc.

Refuse to complete the transaction.

Completely or partially cancel a transaction or exchange. And

We will pursue legal action against you.

11. Account closure

The Nova capital Profile can be closed at any time by contacting us for any reason. However, you cannot close your Nova capital profile or Nova capital account while Nova capital is investigating your use of the Nova capital service, or while your Nova capital account balance remains. If your Nova capital profile is closed, you will continue to be responsible for all actions taken through your Nova capital profile prior to closure.

Nothing in this paragraph 11 affects the legal rights you may have under the laws of the country in which you live.

12. Nova capital suspending and terminating your account.

We may immediately terminate or suspend the use of the Nova capital Services at any time without notice to you in the following situations:

If you provide us with false or misleading information.

In our sole discretion, if we determine that your use of the Nova capital Profile, Nova capital Account is, in any way, harmful or harmful to Nova capital, or potentially harmful.

If you violate these terms or engage in restricted activities.

If you believe you have violated these Terms or otherwise cheated, including during the AML / KYC verification process.

If you need to do so in order to comply with a court order, law, regulation, regulatory decree, or ombudsman order.

Where you were declared bankrupt; and

We are not responsible for any loss incurred if you suspend your account. Nova capital is not required and may be prohibited by law from providing detailed information about account closure or suspension.

We may also terminate your use of your Nova capital Profile and  Nova capital Services at any time by giving you two months' notice.

13. Notification and communication

We will contact you via the Nova capital service or the email address listed in your Nova capital profile. Please update with the email address you check regularly. Also, check your transaction history regularly and let us know if there are any errors or fraudulent transactions. All communication is in English.

14. Customer support

If you need help, or would like to make a comment or complaint, please contact customer service at support@novacapital.info. We aim to resolve all inquiries within two weeks.

15. Unresolved complaints

Give me the opportunity to resolve your complaint. We will respond to your complaint within 15 business days of receiving it, except in exceptional circumstances beyond our control. In any case, we will respond to your complaint within 35 business days of receiving your compliance.

16. Intellectual property

All intellectual property rights in the Nova capital Services, as well as all content and logos, are owned by Nova capital or licensed to Nova capital. This intellectual property without prior written consent cannot be copied, imitated, or used. Nothing in these Terms grants you any intellectual property rights in the Nova capital Services, except in accordance with these Terms, the right to use the Nova capital Services and download mobile applications to your device to access the Nova capital Services.

Your right to use the Nova capital Services is yours and you are not permitted to give this right to others. Your right to use the Access service does not preclude giving others the right to use the Nova capital service.

17. Modification of these conditions

We may change these Terms and Policies at any time. If possible, we will notify you at least two months before these changes. If you do not agree to the changes, you must stop using the service by the scheduled start date of the new changes. Continuing to use the Nova capital service means accepting new changes.

18. Our responsibility to you

Nova capital services allow you to purchase services and merchandise and provide content and information owned or developed by third parties, or content or information that operates or is supported on third-party networks. We are not responsible in any way as we have no control over these services or products you purchase or the content you display using the Nova capital Services.

The functionality of the Nova capital service is a reasonably satisfactory standard and we will do our best to make it available at all times, but certain features may depend on networks and connections beyond our control. Therefore, due to the nature of the Internet and technology, Nova capital services are offered "as is" and "to the extent available." 19. Our right to offset.

In some cases, you may be entitled to compensation from you, for example, if your account balance becomes negative due to a technical error in your favor, or if you use the Nova capital Services in a way that violates these Terms. 20. Your responsibility

You are responsible:

All charges and other amounts incurred through your use of the Nova capital Service at any time, including any unpaid amount if you stop using the Nova capital Service or suspend or cancel your Nova capital Profile.

Comply with all laws, rules, and regulations in your jurisdiction that may apply to you in connection with your use of Nova capital Services, including but not limited to export / export, tax, or foreign currency trading activities. 21. Nova capital to the deceased's account

If you need access to the deceased's Nova capital profile, please contact us. We may ask for supporting documents, such as death certificates, probate documents, or other documents certifying that you have the right to control the property of the deceased.

22. No investment advice

We do not provide any investment advice. We may provide information about currencies and DPT types, prices, and events that may have affected prices, but these should not all be considered investment advice. If you need investment advice, you should contact your financial adviser. You are solely responsible for the use of our Services and the financial consequences of your actions.

23. Governing law and dispute resolution

Mwali International Services Authority law applies to all disputes and the interpretation of these Terms. Courts in comoros union have non-exclusive jurisdiction over disputes arising out of or related to the use of Nova capital Services. This does not affect your rights under the laws of the country in which you reside.
